Elmbridge Borough Council is currently consulting on their revised Regulation 123 List.

What is the Regulation 123 List?

The Regulation 123 List sets out the types of infrastructure that may be funded by CIL in the Borough. The main purpose of the list is to provide transparency around what the Council intends to fund through CIL and those known areas where Section 106 contributions will continue to be sought. The intention is to ensure that there is no duplication in the use of both CIL and S106 for the same project.

The update to the list has been undertaken in partnership with infrastructure providers such as the County Council in order to identify the strategic projects for which CIL funding should be considered.

Importantly, the list should not be viewed as a spending plan for CIL. No list of this type can be exhaustive. The inclusion of a project or type of infrastructure on the list does not signify a commitment from the Council to fund the listed project or type.

Why is it being updated?

Statutory guidance allows the Council to amend the list as it sees fit. The original Regulation 123 list was published in February 2014 based on evidence available at that point in time. It was always intended that the list would be subject to regular review to reflect changing infrastructure need. This update reflects changes in the delivery plans of partners, particularly Education for which significant infrastructure need exists. The additions to the list are highlighted in bold.

Specific infrastructure items that have been delivered have been removed from the list but will be detailed on a separate list to be available on the Council’s website.

The changes set out in the revised list do not have any implications on the level at which CIL is set as the update indicates a continuing infrastructure need and consequently a continued funding gap.

Statutory guidance sets out that revisions to a Regulation 123 List should be subject to appropriate local consultation.  The Council is inviting comments on the draft list between 1st December 2015 and 4th January 2016. The outcomes of the consultation will be reported to the Council’s Portfolio Holder for Regulatory Affairs, prior to its final publication.

You can also view the Regulation 123 List at the reception of the Civic Centre, Elmbridge Borough Council, High Street, Esher KT10 9SD between 8.45am and 5.00pm (Monday to Thursday) and between 8.45am and 4.45pm (Friday).

Responses will be made public and a summary of the consultation findings will be made available on the website.
